1. Acceptance of Terms

By accessing or using SteadScape ("the Service", "Platform"), including SteadSwap marketplace, SteadHub community, and planning tools, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

SteadScape provides:

• SteadSwap: A marketplace platform connecting users to buy, sell, trade, or give away homesteading-related items
• SteadHub: A community platform for discussions and content sharing
• Planning Tools: Subscription-based tools for garden and livestock planning
• Educational Content: Articles and resources about homesteading

3. User Accounts

3.1 Account Creation

You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. SteadSwap Marketplace Terms

4.1 Platform Role

IMPORTANT: SteadScape is a venue only. We provide a platform for users to connect with each other. We do not:

• Participate in transactions between buyers and sellers
• Process payments or handle money
• Take possession, custody, or control of items listed
• Verify the accuracy, legality, or quality of listings
• Guarantee the identity, qualifications, or credentials of users
• Act as an agent, escrow, or fiduciary for any user

4.2 User Responsibility

All transactions occur directly between users. Users are solely responsible for:

• Determining the legality of items in their jurisdiction
• Compliance with all applicable laws (food safety, animal welfare, commerce regulations)
• Accurate descriptions and representations of items
• Meeting all health, safety, and licensing requirements
• Negotiating and completing transactions
• Resolving disputes with other users

4.3 Prohibited Items and Activities

Users may not list or attempt to sell:

• Illegal items or items that violate local, state, or federal law
• Stolen, counterfeit, or infringing items
• Endangered or protected species
• Items requiring special licenses without proof of such licenses
• Diseased animals or contaminated food products
• Weapons, drugs, or other prohibited substances
• Items that pose health or safety hazards

4.4 Listing Expiration

Listings automatically expire after 30 days and are permanently deleted after 60 days. Sellers are responsible for reposting items if they remain available.

5. Fees and Payment

5.1 Marketplace Access

A one-time fee of $19.99 is required to post listings on SteadSwap. This fee is non-refundable and grants lifetime access to post listings.

5.2 Planning Tool Subscriptions

Access to planning tools requires a monthly subscription. Subscriptions auto-renew unless cancelled. Refunds are not provided for partial months.

5.3 Payment Processing

All payments to SteadScape are processed through Stripe. By making a payment, you agree to Stripe's terms of service.

6. Content and Intellectual Property

6.1 User Content

You retain ownership of content you post. By posting content, you grant SteadScape a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.

6.2 Platform Content

All content provided by SteadScape, including text, graphics, logos, and software, is owned by SteadScape and protected by copyright and trademark laws.

6.3 Copyright Infringement

We respect intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us at legal@steadscape.com.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• STEADSCAPE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE ARE NOT LIABLE FOR ANY TRANSACTIONS BETWEEN USERS
• WE ARE NOT LIABLE FOR INJURIES, DAMAGES, OR LOSSES ARISING FROM IN-PERSON MEETINGS
• WE ARE NOT LIABLE FOR FOOD-BORNE ILLNESS, ANIMAL DISEASE, OR OTHER HEALTH ISSUES
• WE ARE NOT LIABLE FOR FRAUD, SCAMS, MISREPRESENTATIONS, OR DISPUTES BETWEEN USERS
• OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS

8. Indemnification

You agree to indemnify, defend, and hold harmless SteadScape, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your listings, transactions, or interactions with other users
• Your violation of these Terms
• Your violation of any law or third-party rights

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Harassment or abuse of other users
• Posting prohibited items
• Repeated complaints from other users

10. Dispute Resolution

10.1 User Disputes

Disputes between users must be resolved directly between those users. We are not obligated to mediate or resolve such disputes.

10.2 Disputes with SteadScape

Any disputes with SteadScape shall be governed by the laws of the State of Missouri, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of courts in Missouri.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or Platform notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Miscellaneous

12.1 Entire Agreement

These Terms constitute the entire agreement between you and SteadScape.

12.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

12.3 No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.
