SteadSwap Marketplace Agreement
Terms and guidelines for buying and selling on SteadSwap

1. Agreement to Terms
By posting a listing on SteadSwap or contacting a seller, you agree to this Marketplace Agreement in addition to our general Terms of Service. This agreement governs all marketplace transactions and interactions.
2. Platform Role and Disclaimer
CRITICAL: READ CAREFULLY
SteadSwap is a venue only that connects buyers and sellers. We are NOT:
- A party to any transaction between users
- A buyer, seller, agent, broker, or intermediary
- A payment processor or escrow service
- An inspector, verifier, or guarantor of items or users
- A shipper, deliverer, or handler of items
- Responsible for anything that happens between users
All transactions, negotiations, payments, and arrangements are 100% between buyers and sellers. You agree to not hold SteadScape liable for any aspect of your transactions.
3. Seller Responsibilities
3.1 Accurate Listings
As a seller, you agree to:
- Provide truthful, accurate, and complete descriptions
- Use your own photos or have permission to use posted photos
- Disclose all known defects, issues, or relevant information
- List items you actually possess and have authority to sell
- Keep listings current and remove sold items promptly
- Honor the price and terms stated in your listing
3.2 Legal Compliance
You are solely responsible for ensuring your listing complies with all applicable laws:
- Food Safety: Eggs, produce, and food items must meet local health codes
- Animal Welfare: Livestock must be healthy, disease-free, and legally transferable
- Licenses: You must hold any required licenses or permits
- Zoning: Compliance with local agricultural and commerce regulations
- Taxes: Reporting and paying applicable taxes on transactions
- Age Restrictions: Compliance with age restrictions for certain items
3.3 Communication
- Respond to inquiries promptly and professionally
- Be available via your listed contact method
- Communicate clearly about availability, pickup/delivery, and payment
4. Buyer Responsibilities
4.1 Due Diligence
As a buyer, you agree to:
- Ask questions before purchasing
- Inspect items thoroughly before accepting
- Verify the seller's identity and legitimacy
- Research fair market prices
- Understand that all sales may be final (unless seller agrees otherwise)
- Not rely solely on listing descriptions
4.2 Safety
- Meet in safe, public locations when possible
- Bring a friend to in-person meetings
- Trust your instincts - if something feels wrong, walk away
- Don't share excessive personal information
4.3 Payment
- Never send money before seeing the item
- Use secure payment methods
- Be wary of deals that seem too good to be true
- Get receipts for your records
5. Prohibited Items and Activities
5.1 Prohibited Listings
You may NOT list:
- Illegal items or items that violate laws
- Stolen, fraudulent, or counterfeit items
- Items you don't own or have authority to sell
- Endangered or protected species
- Diseased, sick, or injured animals
- Contaminated, spoiled, or unsafe food products
- Wild animals or undomesticated livestock
- Weapons, ammunition, explosives
- Drugs, controlled substances, or drug paraphernalia
- Tobacco or alcohol
- Adult content or services
- Human remains or body parts
- Items requiring special licenses without proof of such licenses
5.2 Prohibited Conduct
- Fraud, scams, or misrepresentation
- Bait-and-switch tactics
- Price gouging or price manipulation
- Spam, duplicate, or misleading listings
- Harassment, threats, or abusive language
- Circumventing platform fees
- Creating multiple accounts to evade bans
- Using automated tools or bots
6. Food and Livestock Specific Terms
6.1 Food Products (Eggs, Produce, etc.)
Sellers of food items represent and warrant that:
- Items are safe for human consumption
- Items have been handled, stored, and transported safely
- Items comply with local food safety regulations
- Sellers hold any required permits or licenses
- Items are accurately labeled with relevant information
Buyers acknowledge: Purchasing food from individuals carries inherent risks. You assume all risk of food-borne illness or contamination.
6.2 Livestock and Animals
Sellers of animals represent and warrant that:
- Animals are healthy and disease-free
- Animals have received appropriate veterinary care
- Animals meet breed standards claimed in listings
- All required health certificates and documentation are provided
- Sellers comply with animal welfare laws
Buyers acknowledge: You are responsible for verifying animal health, obtaining necessary permits, and ensuring you can legally keep the animal in your location.
7. Dispute Resolution
7.1 Between Users
Disputes between buyers and sellers must be resolved directly between those parties. SteadScape is not obligated to mediate, arbitrate, or resolve disputes.
7.2 Reporting Issues
You may report violations of this agreement or suspicious activity to marketplace@steadscape.com. We will investigate but make no guarantees about outcomes.
8. Listing Fees and Expiration
- Access Fee: $19.99 one-time fee for lifetime posting access
- No Commission: We do not charge commission on sales
- Listing Duration: Listings expire after 30 days
- Automatic Deletion: Expired listings are permanently deleted after 60 days
- Reposting: You may repost expired items if they remain available
9. Intellectual Property
- Only use photos you own or have permission to use
- Do not use copyrighted or trademarked content without permission
- Do not post counterfeit or infringing items
10. Platform Rights
SteadScape reserves the right to:
- Remove any listing at any time for any reason
- Suspend or terminate user accounts
- Investigate reported violations
- Share information with law enforcement if required
- Modify marketplace features, fees, or policies
- Refuse service to anyone
11. Limitation of Liability
BY USING STEADSWAP, YOU AGREE THAT:
- You use the marketplace entirely at your own risk
- SteadScape is not liable for any damages, losses, or injuries arising from transactions
- SteadScape is not liable for fraud, scams, or misrepresentations by users
- SteadScape is not liable for food-borne illness, animal disease, or health issues
- SteadScape is not liable for personal safety issues during in-person meetings
- SteadScape is not liable for failed transactions or disputes
- SteadScape is not liable for items not matching descriptions
12. Indemnification
You agree to indemnify and hold harmless SteadScape from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your listings or transactions
- Items you sell or purchase
- Your interactions with other users
- Your violation of laws or regulations
- Your violation of this agreement
13. Acknowledgment and Acceptance
By posting a listing or contacting a seller on SteadSwap, you acknowledge that:
- You have read and understand this Marketplace Agreement
- You agree to be bound by its terms
- You understand SteadScape is a venue only
- You accept all risks associated with marketplace transactions
- You will not hold SteadScape liable for any aspect of your transactions
